General Terms and Conditions of Business

1.    Scope
These General Terms and Conditions (hereinafter referred to as ‘GTC’) apply to all legal transactions concluded via the TCS Clubshop online shop www.clubshop.ch (hereinafter referred to as TCS Clubshop). The TCS Clubshop is operated by Pandinavia AG, Industriestrasse 30, 8302 Kloten, on behalf of the Touring Club of Switzerland (TCS).

Pandinavia AG reserves the right to change these GTC at any time. The version of these GTC valid at the time of the order applies and cannot be unilaterally changed for the order in question. The invalidity of individual provisions of these GTC does not affect the validity of the remaining provisions.

The offer in the TCS Clubshop is aimed exclusively at customers with their place of residence or registered office in Switzerland or Liechtenstein, and deliveries are made exclusively to addresses in Switzerland and Liechtenstein.

The offer is valid as long as the product can be found in the TCS Clubshop and/or while stocks last.

2.    Products
Images of products in the TCS Clubshop and advertisements are for illustrative purposes only and are not binding.


3.    Prices
The prices of items in the shop are quoted in Swiss francs (CHF) and include statutory value added tax and, where applicable, the advance recycling fee (ARF). Pandinavia AG reserves the right to change the prices of the products and services offered at any time. The price in the TCS Clubshop at the time of ordering is decisive for the conclusion of the purchase contract.


4.    Availability
Pandinavia AG attaches great importance to providing up-to-date and accurate information on availability and delivery times. However, delivery delays cannot be ruled out due to bottlenecks in production or logistics. All information on availability and delivery times is therefore subject to change and may be altered at any time.

5.    Ordering
All orders are binding. In your own interest, please ensure that the delivery address and telephone number you provide us with are correct and complete. We cannot accept any liability for delays or non-deliveries resulting from incorrect or incomplete addresses. We reserve the right to change product specifications without prior notice.

Once your online order has been received, the TCS Clubshop will automatically send an order confirmation to the e-mail address you provided. The order confirmation does not constitute a binding commitment to deliver, but merely confirms receipt of the order and the conclusion of the purchase contract, subject to availability and correct pricing. If you do not receive a confirmation, the order process has probably not been completed correctly.


6.    Payment
Customers can use the payment options offered in the online shop under ‘Payment options’. There is no option for purchase on account and only fully paid orders can be processed.

7. Delivery, shipping and packaging costs
The execution of the order depends on the availability of the products. Orders are usually processed immediately and items that are in stock are shipped within 1 to 3 working days. If this is not possible, we will notify you. Shipments may be made in more than one package. Items will be shipped as soon as they are available. Regardless of the number of deliveries, only one set of delivery costs will be charged per order.

If the TCS Clubshop is in default of delivery, customers are entitled – with the exception of special orders – to withdraw from the contract from the 30th calendar day after the delivery date specified in the order confirmation. In this case, any payments already made will be refunded in full. Further claims against Pandinavia AG are excluded.

The shipping costs are CHF 9.50 and refer to the standard delivery service of 1 to 3 days. Orders with a goods value of at least CHF 100 are free of shipping costs.

The delivery address must be easily accessible by lorry. If this is not the case, the customer shall bear any additional costs. If the customer does not accept the delivery, the TCS Clubshop may withdraw from the contract and charge the customer for the delivery costs incurred and any loss in value.

8.    Inspection obligation / Damaged items
Customers must immediately check delivered products for correctness, completeness and delivery damage. Delivery damage, incorrect and incomplete deliveries must be reported to the TCS Clubshop within 5 calendar days of delivery. The report must be made by completing the form at this link. Such products must not be used and all parts of the original packaging must be retained.

Returns that cannot be assigned to a customer or that cannot be returned to the customer will be stored by the TCS Clubshop for a period of three months and then disposed of. In such cases, a refund of the purchase price is excluded.


9.    Right of return
Unused items can be returned within 14 days of delivery in their undamaged original packaging. If the original packaging is missing or damaged, a reduction in value of at least 20% of the purchase price may be claimed. If the return is proper and free of defects, we will refund the full purchase price, excluding shipping costs. 

Please note that returns must be made in accordance with the instructions of the TCS Clubshop.

During the period in which the defect is being rectified, there is no entitlement to the provision of a free replacement product.

10. Warranty conditions
The TCS Clubshop provides a warranty covering the absence of defects and the functionality of the products for a period of three years from the date of delivery. In the event of a warranty claim, the customer is entitled to repair, replacement or rescission (cancellation) of the purchase contract. The decision on the type of remedy lies with the TCS Clubshop.

The warranty does not cover wear parts or damage and defects resulting from improper handling, storage, external influences, external interference or normal wear and tear.

The above warranty conditions apply in addition to the mandatory statutory warranty rights to which customers are entitled without restriction. Further claims are excluded to the extent permitted by law.

To assert a warranty claim, the instructions for warranty processing must be strictly adhered to.
Warranty and guarantee claims are only available to the direct purchaser and are not transferable.

11. Liability and disclaimer
The TCS Clubshop does not guarantee the completeness, timeliness or accuracy of the content provided on the platform. Likewise, no liability is assumed for any misuse of the content by third parties. This also applies to content on external websites that are accessible via hyperlinks on the platform; the respective providers are solely responsible for their content.

Claims for damages – regardless of their legal basis – in particular due to impossibility of performance, breach of contract, culpa in contrahendo or tort, are excluded unless there is evidence of intent or gross negligence. Liability for indirect damage, consequential damage or damage resulting from malfunctions or service failures is excluded.

Due to technical circumstances, communication via the internet is neither confidential nor secure. In this context, the TCS Clubshop accepts no liability for any damage resulting from the use of electronic means of communication.

12. Intellectual property rights
All content on the platform – including, but not limited to, trademarks, company names, logos, images, text, graphics, software programmes and digital media objects – is the property of TCS Clubshop or its partner companies and is protected by copyright, trademark rights and other intellectual property rights.

Any use of this content for commercial or private purposes, in particular the complete or partial copying, transmission (by electronic or other means), reproduction, modification, linking, public display, distribution or other exploitation, is not permitted without the express prior written consent of TCS Clubshop.

13.    Data protection
We undertake not to sell your personal data to third parties. All personal data will, of course, be treated confidentially. The data necessary for business transactions will be stored.

Credit card payments are encrypted using proven SSL technology. They are processed via Saferpay (Wordline). Wordline processes your personal data on our behalf in connection with the payments you have made to us. Your data will only be used by Wordline to process your payment instruction and will not be made available to any third parties other than the financial institutions responsible for the respective payment method. ‘Wordline’ or ‘Saferpay’ may appear on your credit card or bank statement in connection with your order from us.

14.    Place of jurisdiction
With regard to end consumers, their place of residence shall be the place of jurisdiction. In all other cases, the place of jurisdiction shall be 8180 Bülach (ZH), Switzerland.
